Use of the Rare Edition Designs Ltd Website
The contents of the website are subject to the laws of copyright. No part of the website may be distributed or copied for any commercial purpose and you may not incorporate any part of it in any other work (whether in hard copy, electronic or any other form). No part of the website may be published, copied, transmitted or stored (including in any other website or other electronic form) except that individuals may make reasonable use of the material for the purpose of reviewing and ordering goods.
The contents of the website may include links to third party materials (linked sites). We will not be responsible for the contents of any linked site or liable for any direct or indirect loss or damaged suffered by you from accessing, using, relying on or the trading with third parties. The inclusion of a link does not imply our endorsement of any site or any association with its operators.
Placing an Order
When placing an order from this website you should use the order page provided. For your own security do not send credit card details via email to us. The Direct Payment Solutions (DPS) payment system has an encrypting facility for your security.
On receipt of your order we will endeavour to supply you with the goods ordered, but we will not be liable to any person if we decline to fulfil or are unable to fulfil an order. We reserve the right to contact you to verify payment, delivery or other customer details. We also reserve the right to cancel an order and refund any payments made.
Prices are in New Zealand dollars and include New Zealand Goods and Services Tax (“GST”). For goods shipped by us directly to an address outside New Zealand, GST is not payable and will be deducted from the price. Prices are subject to change without notice. For orders delivered outside New Zealand you are responsible for any duties, fees or taxes applicable under your local law.
Postage and Handling
Postage, handling and insurance is payable by you as per the details provided on the order page. Delivery is by courier and may only be made to a street address. Where inaccurate or incomplete details are provided and additional delivery costs are incurred, you will be liable to pay these costs. We cannot guarantee timing of delivery.
If you are unhappy with your purchase for any reason, we will provide a full refund to you via the original method of payment (excluding postage unless the item is faulty or not what you ordered) provided you return it to us in its original condition, unused and unwashed within 14 days of receipt. Please include your original invoice details and your product feedback so that we can learn from your experience.
If you receive a faulty product please return it and it will be either repaired or replaced at our discretion. We will reimburse return postage costs. In the event that an exact replacement is not available a credit or refund will be issued.
Please note that as these are original hand made products, imperfections in the print of the product are not considered faults but are part of the design.
Given the limited edition nature of our products, while every effort will be made to provide you with the product you have requested, if it is unavailable we will contact you to advise you as soon as possible. If an alternative product is deemed unsuitable by you then any payments already made will be refunded immediately.
Goods supplied by us will remain our property until payment in full is received. In the event that we need to enforce our right to recover any money from you, we have the right to recover all costs, including legal costs incurred on a solicitor client basis required to recover such debt.
Detailed care instructions are provided with our products and must be followed. No responsibility or rectification will be taken for items damaged as a result of incorrect usage or care.
Where goods are advertised with reference to a photograph, we cannot guarantee that your monitor’s display of any colour will be accurate. We will endeavour to deliver the corresponding goods but do not warrant that the goods we deliver to you will be identical to those displayed in the photograph or on your monitor.
Risk and Ownership
Risk in goods purchased from us will pass to you on delivery but legal and beneficial ownership in goods remains with us until all sums owed to us in respect of those goods and all other goods supplied by us are paid in full. While property in the goods remains with us, we have the irrevocable right to enter your premises where the goods are located and take possession of and remove the goods. Until ownership passes, you hold the goods as bailee for us. If you wish to resell any goods before ownership passes, you may do so only by way of a good faith sale in the ordinary course of business and you shall account to us for the proceeds of any such sale.
Much effort has been made to ensure the accuracy of information, opinions and ideas expressed on this website. Similarly, photographs/pictures/visuals are designed to accurately represent the details of products available for sale on the website (including colours etc.). However, we cannot accept responsibility or liability for any loss resulting from reliance upon information or images displayed on this website.
We expressly exclude to the fullest extent permitted by law all warranties, descriptions, representations or conditions whether implied by law, trade, custom or otherwise.
Limitation of Liability
Our liability for any claim, damages, loss, or expense related to the supply by us of goods or services is limited to the cost paid by you for the goods or services and except where statute expressly requires otherwise. To the fullest extent permitted by law we will not be liable in any event whether in tort (including negligence), contract or otherwise for any loss of profits or any consequential, indirect or special damage, loss or injury of any kind suffered by you or any other person.
Consumer Guarantees Act 1993 (“the Act”)
If you are a consumer under the Act and you are acquiring or holding yourself out as acquiring the goods for a business purpose, the Act will not apply. Subject to this clause nothing in these terms will affect your rights as a consumer under the Act.
If any portion of these terms is deemed to be invalid, illegal or unenforceable, the remaining provisions shall remain in full force and effect.
These terms will be governed by New Zealand law and you agree to submit to the exclusive jurisdiction of the New Zealand Courts. The application of the United Nations Convention on Contracts for the International Sale of Goods is expressly excluded.
